International Legal Regulation of Mass Email Sending Policy

At Ectoprocta Technologies Limited ("Bryozoan", "we", "our", or "us"), we are committed to ensuring that all email campaigns conducted through our Services comply with international regulations governing commercial and marketing communications. This policy explains how Bryozoan AI aligns with global anti-spam and data protection laws, and the responsibilities of our customers when using our platform.

1. Our Commitment

We design Bryozoan AI to support ethical, compliant, and effective email outreach. We strictly prohibit spam and require that all users comply with applicable email and privacy regulations in the jurisdictions where they operate, including but not limited to:

  • CheckUnited Kingdom & European Union: UK GDPR, EU GDPR, and the Privacy and Electronic Communications Regulations (PECR).
  • CheckUnited States: CAN-SPAM Act.
  • CheckCanada: CASL (Canada's Anti-Spam Legislation).
  • CheckAustralia: Spam Act 2003.
  • CheckOther Regions: Any applicable local laws governing email marketing and data protection.

2. Consent and Opt-In

  • CheckUsers must ensure recipients have given valid consent where required by law (e.g. GDPR, CASL, PECR).
  • CheckIn jurisdictions where opt-out rules apply (e.g. CAN-SPAM), users must maintain accurate records of consent or lawful grounds for sending emails.
  • CheckPurchased or scraped email lists are strictly prohibited.

3. Identification and Transparency

All commercial emails sent via Bryozoan must:

  • CheckInclude accurate subject lines that are not misleading.
  • CheckProvide valid sender contact details.
  • CheckState the nature of the communication (e.g. marketing, promotional).

4. Unsubscribe and Recipient Rights

  • CheckEvery email must include a clear and functioning unsubscribe mechanism.
  • CheckUnsubscribed contacts must be removed from future campaigns within the timeframe required by law (typically within 10 business days under CAN-SPAM; immediately under GDPR/PECR).
  • CheckRecipients' rights under applicable laws (e.g. access, deletion, restriction under UK GDPR) must be respected.

5. Data Protection and Processing

  • CheckBryozoan acts as a data processor when handling Customer Data (email lists, recipient details, outreach content).
  • CheckCustomers remain the data controller and are responsible for ensuring lawful collection and use of recipient data.

6. Customer Responsibilities

When using Bryozoan AI, customers must:

  • CheckEnsure compliance with all applicable email, marketing, and data protection laws.
  • CheckOnly send emails to recipients who have provided appropriate consent or where another lawful basis applies.
  • CheckMaintain accurate records of consent and unsubscribe requests.
  • CheckAvoid sending high-volume unsolicited messages that could trigger spam filters or blacklisting.

7. Enforcement

Bryozoan may suspend or terminate accounts found to be in violation of this policy or applicable regulations. We may also report unlawful activity to relevant authorities.

8. Governing Law and Jurisdiction

This policy, and any dispute or claim arising out of or in connection with it, shall be governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
